Todo indiv\u00edduo \u00e9 titular de direitos. Mas existem direitos que ultrapassam o \u00e2mbito estritamente individual. Em sentido amplo, esses direitos s\u00e3o chamados de direitos coletivos. Quando um direito coletivo n\u00e3o \u00e9 respeitado, muitas pessoas s\u00e3o prejudicadas e o Minist\u00e9rio P\u00fablico ou entidades legitimadas (sindicatos ou associa\u00e7\u00f5es civis) podem ajuizar a a\u00e7\u00e3o coletiva em defesa da coletividade.<\/p>\n
As a\u00e7\u00f5es coletivas de consumo asseguram uma prote\u00e7\u00e3o efetiva dos direitos vulnerados no \u00e2mbito de uma sociedade de consumo de massa.<\/p>\n
Evita-se, assim, a pulveriza\u00e7\u00e3o de lit\u00edgios similares e, ao mesmo tempo, assegura-se a economia processual e a efetividade na defesa dos direitos positivados na legisla\u00e7\u00e3o p\u00e1tria.<\/p>\n
As a\u00e7\u00f5es Coletivas de Consumo n\u00e3o s\u00e3o privativas de ningu\u00e9m, estas pertencem a toda a coletividade. Assim, qualquer cidad\u00e3o poder\u00e1 se beneficiar por uma senten\u00e7a procedente transitada em julgado, pois os seus efeitos tem efic\u00e1cia erga omnes.<\/p>\n
Exemplo: Considerando-se uma a\u00e7\u00e3o civil, interposta por uma entidade de defesa do consumidor contra um banco, em que se discute a nulidade da cl\u00e1usula abusiva para a cobran\u00e7a de TLA \u2013 Tarifa de Liquida\u00e7\u00e3o Antecipada. Desse modo, tem-se que todos os consumidores que foram e vierem a ser v\u00edtimas da cobran\u00e7a de TLA \u2013 Tarifa de Liquida\u00e7\u00e3o Antecipada pelo banco r\u00e9u da a\u00e7\u00e3o coletiva \u2013 constituem os titulares do direito coletivo sob comento, uma vez que somente a eles interessa o pedido elaborado nessa a\u00e7\u00e3o, ou seja, a proibi\u00e7\u00e3o da tarifa de liquida\u00e7\u00e3o antecipada e a nulidade dos contratos j\u00e1 celebrados.<\/p>\n
